2. Scope
Schenk Suisse SA operates an online store at thewinefamily.ch . The general conditions of sale apply to all orders placed with thewinefamily via the thewinefamily.ch website or by order form, email, telephone, purchase in store or at fairs.

The offer is only valid for Switzerland and Liechtenstein.

The products offered online are valid as long as they appear on the website and while stocks last. The description sheets and images specific to each item are given for information and illustration purposes only and are without obligation.

3. Order
Any order from one packaging unit is honored. A sales contract is deemed concluded between the parties as soon as Schenk Suisse SA confirms their order to the customer by e-mail. In principle, we only allow the conclusion of orders for items physically available in our stock. However, if a difference in inventory prevents us from delivering an item, we reserve the right to replace an out-of-stock vintage with a more recent vintage of the same quality without prior notice. Nevertheless, if no other vintage is available, we undertake to inform you as soon as possible and to offer you alternative products. In this case, you can decide whether to accept our offer or cancel your order.

4. Price
All prices displayed are in Swiss francs, 8.1% VAT included, without delivery costs. The prices displayed at the time of the order are applicable subject to modification of the assortment, vintages, availability of items as well as the correction of obvious errors or typing errors. Schenk Suisse SA may carry out promotions on its assortment. These offers are only valid during the period of publication on the site and cannot be requested retroactively.

5. Promotional codes and gift vouchers
The value of the merchandise must be at least equal to the amount of the promotional code or gift voucher. For administrative reasons, reimbursement of any residual value is not possible.
Deducting the amount from a promotional code or gift voucher retrospectively is not possible. The value of a promotional code or gift voucher cannot be paid in cash. It is not possible to combine several promotional codes or gift vouchers per order.


6. Payment: The customer can pay for his order in the following way:

  • By invoice with payment slip
  • By credit card: Mastercard, Visa
  • By TWINT
  • By PayPal

In the event of payment by invoice, the sales price expires on the day the delivery is received by the customer. Invoices are payable within 30 days from the invoice date, without deductions, such as discounts or other rebates. Unjustified deductions will be re-invoiced. Payment by invoice is only available for orders not exceeding CHF 500.-. For amounts exceeding this sum, prior authorisation must be requested from our Customer Service department at the following e-mail address: service@thewinefamily.ch. A credit check will be carried out by our finance department, which will decide whether or not to grant the privilege of payment by invoice for amounts in excess of CHF 500.-. We reserve the right to refuse or accept payment by invoice, regardless of the amount, depending on the customer's creditworthiness. It should also be noted that payment by invoice is not available for the first order placed from a new customer account.

If purchased by credit card, your credit card account is debited at the time the order is completed. We reserve the right to deliver only against payment by card or advance payment. Only payment by credit card is accepted when purchasing gift vouchers.

6.1 Refund procedures
Refunds, whether total or partial, will only be made by the same payment method used to purchase the order concerned.

7. Delivery
No delivery costs are charged for orders worth more than CHF 300.-.
Below this amount, a contribution to delivery costs of CHF 12.- is charged.

Schenk Suisse SA limits deliveries to Switzerland and Liechtenstein.
Delivery is made to the delivery address indicated by the customer.
For orders of less than 24 bottles, Schenk Suisse SA reserves the right to use its trusted logistics provider for delivery.
Schenk Suisse SA reserves the right to charge additional transport costs of CHF 12.- in the event of a first unsuccessful delivery attempt.

In the event of temporary unavailability of an item or a pre-order, Schenk Suisse SA may have to deliver the same order in several installments. In this case, Schenk Suisse SA undertakes to invoice any contribution to delivery costs only once.

8. Packaging
The products ordered are delivered in reinforced cartons containing 1, 2, 3, 4, 6 or 12 bottles, depending on the order. Glass is not returnable.

9. Reservation of title
The goods remain the property of Schenk Suisse SA until full payment, including any contribution to delivery costs.

10. Satisfaction Guarantee
We do everything we can to offer you the highest quality products. If, however, the merchandise ordered does not satisfy you, you have one month to report this fact to our customer service. In this case, our advisor will find a solution with you.

11. Return of defective bottles
Following the decision of the Swiss General Assembly of Wine Merchants of June 10, 1988 and according to the arts. 197 et seq. of the Code of Obligations: Wines bottled in Switzerland will be replaced or refunded for one year from the delivery date. Foreign wines bottled in the country of production will not be replaced.

12. Sale of alcoholic beverages to minors
Legal requirements in force in Switzerland prohibit the sale of wine to people who are not over 16 years old. By accepting these general conditions of sale, you confirm that you comply with the legal provisions.

13. Applicable law and legal forum
These general conditions of sale are subject to Swiss law. Any dispute relating to sales concluded within the framework of these general conditions will be under the exclusive jurisdiction of the courts of the canton of Vaud, subject to possible recourse to the Federal Court.

14. Data protection
We store your order data and postal details for use in the execution of the order (this may also be entrusted by us to fulfillment partners or shipping partners), to process possible warranty cases, to improve our offer and to suggest products to customers, in accordance with the content of our data protection declaration .

15. Modifications and additions
Schenk Suisse SA expressly reserves the right to adapt these general conditions at any time to the circumstances and to apply them immediately. In particular, Schenk Suisse SA undertakes to immediately incorporate the amended or supplemented conditions of the credit card organizations
